Apple wants sole domain of the term "pod". With ipod sales' cooling it doesn't surprise me.

The company Podcast Ready developed software to allow podcasts to be delivered directly to digital music players (article). Key thing there to notice is "digital music players" not just Apple's iPod...Apple fans think on that for a bit... I'll wait........ok done?

Microsoft...I mean Apple had this utterly ridiculous response:

"The term pod has been adopted and used extensively in the marketplace by consumers as an abbreviation to refer to Apple's iPod player."

Um what the heck? Hey man come listen to my pod. Who the heck says that? Pod has been and is everywhere and like it or not “Podcast” has become a generic term.

“Podcasting" was declared last years "word of the year" by The New Oxford Dictionary defining it as "a digital recording of a radio broadcast or similar program made available on the Internet for download to a personal device."

Ernest W. Grumbles III, a partner in Merchant & Gould's litigation practice in Minneapolis said in a recent MacNewsWorld article, "it strikes me that a court would think it is unfair to create a new generic term and then try to establish rights to it." (read article)

This particular use of the word "pod" is not a slam-dunk case for Apple, agreed Gregory Rutchik, senior counsel at Liner Yankelevitz Sunshine & Regenstreif in San Francisco. "Podcast Ready is a service, and 'podcasting' describes a behavior," he told MacNewsWorld. That said, it can also be argued that Podcast Ready is an assault on iTunes, he added.(read article)

Now I have probably already lost any Apple fans after the first sentence of this rant, but here is a company that has survived on an anti-establishment mythos and is anything but.

Podcast Ready is technology that enables any digital music player to download podcasts directly. It does what iTunes does for everyone else. It’s clear that “podcast” has become a generic term for a audio XML feed, but Apple wants to keep users trapped in their own little world.

They make software for their hardware only. Apple has always been in its own little proprietary "pod". With proprietary software, hardware, and computer accessories since it began, and they tried to hold on to that for as long as they could get away with it in their computers. Once that ship sailed they are trying the same strong arm non competitive tactics they always have with their music players.

Perceived underdog or not Apple has always been about money and always will and the myth of being outside the evil corporate world will continue to be perpetuated in the minds of those blind rabid fans who don’t dare admit to themselves they have been suckered.

It doesn’t shock me for a bit that Apple is once again in fear of free market competition even though they spin themselves as champions against that type of oppression.

From her Web site, Terryfic.com, Wilson markets a line of decorative, patterned laptop protectors that she calls Tightpods. She offers the handcrafted Spandex covers in more than 70 tones and patterns, including Gold Lame, Tiger, Snake and Tropical Hibiscus.

Wilson, who has been making her computer covers for about a year, settled on the name Tightpod because the covers fit snugly, and they protect their contents, like a pod. (read article)

But she got a happy cease-and-desist order from Apple.

The order from Apple reads in part: "The Tightpod mark will inevitably cause consumer confusion as to the source of the products, and dilute Apple's famous iPod mark."

This is typical Steve Jobs logic who once said that Apple doesn’t make two buttons mice because it would confuse their consumers. Apple views people as morons.

The most interesting point came in a user comment on one of the articles:

Just a touch ironic that a company who violated a patent agreement over a name (Apple v. Apple Records) would then sue another upstart over a patented name.

- Rodney, New York

I rest my case.

Lyrics:

You see me mowin' my front lawn
I know they're all thinkin' I'm so
White and nerdy

Think I'm just too white and nerdy
Think I'm just too white and nerdy
Can't you see I'm white and nerdy
Look at me I'm white and nerdy

I wanna roll with the gangstas
So far they all think I'm too
White and nerdy

Think I'm just too white and nerdy
Think I'm just too white and nerdy
I'm just too white and nerdy
Really, really white and nerdy

First in my class here at MIT
Got skills, I'm a champion at D&D
M.C. Escher, that's my favorite M.C.
Keep you're 40, I'll just have an Earl Grey tea
My rims never spin, to the contrary
You'll find that they're quite stationary
All of my action figures are cherry
Stephen Hawking's in my library

My MySpace page is all totally pimped out
Got people beggin' for my top eight spaces
Yo, I know pi to a thousand places
Ain't got no grills but I still wear braces
I order all of my sandwiches with mayonnaise
I'm a wiz at Minesweeper, I could play for days
Once you've see my sweet moves, you're gonna stay amazed
My fingers movin' so fast I'll set the place ablaze

There's no killer app I haven't run (run)
At Pascal, well I'm number one (one)
Do vector calculus just for fun
I ain't got a gat, but I got a soldering gun (what?)
Happy Days is my favorite theme song
I could sure kick your butt in a game of ping pong
I'll ace any trivia quiz you bring on
I'm fluent in Java Script as well as Klingon
Before I sing on

You see me roll on my Segway
I know in my heart they think I'm
White and nerdy

Think I'm just too white and nerdy
Think I'm just too white and nerdy
Can't you see I'm white and nerdy
Look at me I'm white and nerdy

I'd like to roll with the gangstas
Although it's apparent I'm too
White and nerdy

Think I'm just too white and nerdy
Think I'm just too white and nerdy
I'm just too white and nerdy
How'd I get so white and nerdy

I been browsin', inspectin' X-Men comics
You know I collect 'em
The pens in my pocket, I must protect them
My ergonomic keyboard never leaves me bored
Shoppin' online for deals on writable media
I memorized Holy Grail really well
I can recite it right now and have you R-O-T-F-L-O-L

I got a business doing websites (websites)
When they need some code, who do they call?
I do HTML for 'em all
Even made a homepage for my dog, yo
I got myself a fanny pack
They were havin' a sale down at The Gap
Spend my nights with a role of bubble wrap
Pop, pop - hope no one sees me gettin' freaky

I'm nerdy in the extreme
Whiter than sour cream
I was in AV club and glee club
And even the chess team
Only question I ever thought was hard
Was "Do I like Kirk or do I like Picard?"
Spend every weekend at the Renaissance fair
Got my name on my underwear

They see me strollin', they're laughin'
And rollin' their eyes cause I'm so
White and nerdy

Just because I'm white and nerdy
Just because I'm white and nerdy
All because I'm white and nerdy
Holy cow, I'm white and nerdy

I wanna bowl with the gangstas
But oh well, it's obvious I'm
White and nerdy

Think I'm just too white and nerdy
It was at the JD Estates Park on 4th and Bryant. The City recently remodeled the entire park and put in new playground equipment and sidewalks.

We had two parties in one since they were both turning 4 and their birthdays are so close together anyway.

Both Kennady and Parker wanted to have dog themed parties, so Parker's party was "Puppies", and Kennady's party was "Poodles". They each had dog-house cupcakes and dog bone cookies in the color that they picked.

It worked out great, about the only trouble we had was the wind and waiting for folks to clear out so we could get the pavilion we reserved. The kids seemed like they really had fun.

A side note; I also designed the Birthday party invitations. Parker wanted me to draw a puppy for his party but not just any puppy he wanted Zacky his favorite stuffed dog toy.

I've missed so much in the last couple of months and I realize I just wont be able to get caught up on everything.

I wanted to post about visits that we had from family in Arizona as well as other things like my recent birth of a kidney stone. It was painful labor and we had to give it up. It was recently adopted by a friendly urologist.

Anyway I've decided that I need to upgrade azoidx.com and it looks like it's going to be a big complex project. I realize my passion for keeping up-to-date has died some because of how cumbersome it is to keep this place spam free. I am getting swamped with comment and track back spam because the version is so out of date; to the point I literally can't even keep up.

Anyway I hope to get started soon and until then I will try and at least cover some of the big traditional events like birthdays and such. Parker just turned 4 so pictures of that are on the way.

I will probably try and also throw up the occasional random post still.

I don't know what I did right but this year has been a smorgasbord of entertainment for me; movies, television, DVD's, music...

There have been some really fun movies like X-men III, Superman Returns, Pirates of the Caribbean, Cars, etc... Also the new Spider-man III trailer was unbelievable. Sam Raimi and Co. really really really know how to do movie trailers right. You can't watch it and not be motivated to see this film.

There have been some really great shows come out here at the end of summer as well. I've been watching Blade the series which has been excellent. Also a sleeper hit for me is "Who wants to be a Superhero" it’s a show I wasn't prepared to like, but it's really fun to watch, the plot of the show is really good, and Stan Lee lives up to his nickname “the man”.

We’ve also been watching Eureka. It’s fun to watch but a bit disjointed and not really hit a groove yet.

I’ve also been watching TV on DVD. I bought one of my favorite shows as a kid “Sledge Hammer”. It was like going back in time and bought back so many great memories. It is clear this was one of the many TV shows that had an influence on my sense of humor.

Another vintage TV show I picked up was Alf season one. I bought it for nostalgia and to see if they kids would like it and I discovered that I completely forgot how much I love this show. It was such an incredibly quirky concept for a TV show.

There has also been a flood of new DVD’s coming out.

I have been waiting since TV shows started coming out on DVD for The Weird Al Show, Brisco County Jr., and most of all Jack of All Trades; all of which are out now. Also I’m also planning to buy Animaniacs, and Arrested Development Season 3.

I bought Jack of All Trades. Let me tell you this series is a blast and didn’t get the attention it so highly deserved when it was on TV (they put it on Saturday afternoon and it never got a chance). Jack of all trades is part Moonlighting part Hogan’s Hero’s but really all so originally genius and bizarre.

If nothing else to see Vern Troyer (Mini Me in the Austin Powers films) as Napoleon and Bruce Campbell, one liners and all, at his best is worth the watch. How many comedy shows take place early 19th century post-revolutionary war? Huh? Huh?

I will eventually get Briso County as soon as I have some extra money or a kind soul buys it for me *wink* *wink*...yeah right.

To top it all off Weird Al has more stuff being released right now than he has in the last 4 years. More about that in the next post.

We had Alex's 6th Birthday Saturday July 22nd at mom's house.
Alex chose a pirate theme for his party.

I created a custom invitation (above). I drew the little pirate and created the map and the text in photoshop. I am planning on making all the party invitations from here on out. (I need to get started on Parkers!)

We were so behind that Brandi had to call everyone anyway and she ended up hand delivering the invitations later that week.

We had a blank cake made at Walmart and Brandi did the decorating on it. I was skeptical and a real pain in the butt about it, but she pulled it off great and instead of cake I had to eat crow.

We had a swimming party. Mom had her pool and we also put out a slip and slide.

The weather turned out to be really good; it was hot enough to want to swim but not so hot you couldn’t stand being outside.

We ordered pizza from Little Caesars and even though they don’t open until 11am we called the night before and they said they would make them and could be picked up at 10:30am. I got down there and they forgot but made them pretty quickly so I wasn’t too late.

Here are some photos:

Alex turned 6 July 19th. I went to work in the morning then at noon, after a meeting with a new company I am doing contract for, Brandi came and picked me up and we all went to see the movie "Cars" at the Harkins Theatre.

That movie was great, and I am not afraid to admit I thought it was a quite touching little film. It also top quality animation as we have come to expect from Pixar. I highly recommend seeing it.

That evening we had the family come over and then went out to eat at Jimmy’s Roundup café. Alex loves that place and always get pancakes so it was his call.

Alex got a Lego Xpod from Parker, Aquarium from Kristen, Joe, Mya, and Kennady with all the accessories to go with it. (she is all taking Alex to get a fish). Mom got Alex this cool Pirates of the Caribbean mega blocks set as well as some clothes and 6 dollars.

Brandi, Parker and I also got Alex a Dragon Flyz figure with Dragon.

It’s always fun to load up in the car in our pajamas and drive down to a local church parking lot to watch them.

Sunday we did the also traditional trip to the Eagle Heights Church fireworks. We met up with mom and Kristen, Joe and the kids. The kids played on the inflatables before the show started.

The afternoon of Monday the 4th we went to the Buck Thomas Park to see the big 4th of July event they have there. We went to see the radio controlled airplanes and almost missed them. We did miss the show but got to see some of them flying around anyway.

We checked out some of the booths and stopped and watched a magic show. We also stopped and checked out the cars in the car show. There was a very large showing of classic mustangs.

It was very very hot.

After we left we headed to mom’s house. We ate and had a great time and when it got dark I got to whip out my fireworks. I bought 3 packs of large artillery fireworks on the way home from Wisconsin, and Kristen picked up lots of other smaller stuff for the kids.

We had a bunch of fireworks more than normal. It was lots of fun. Joe and I tried firing off 2 of the artillery shots at a time and I managed to get burnt every time because those dang fuses are not meant to be held in your hand; they are too fast.

When I bought my fireworks the guy stuck in a handful of extras which included a large rocket. I have had bad experiences with a rocket so I am always very suspicious of them. There is no predicting where it will go and they are extremely powerful.

We fired this one off and it was super fast and left a thick plume of smoke. This one proved once again that they are dangerous and unpredictable as usual and curved back towards the house landing somewhere behind it. Any lower and it could have been bad.

The Branum’s and their boys came down and watched what we had left and also brought down some massive sparklers; biggest ones I have ever seen.

For the finale Joe and I managed to light 3 artillery shots at the same time. I of course held all three fuses together by hand while Joe lit them. Yeah I was burnt pretty bad but it was worth it. They all fired perfectly.
